



This Personal Data Privacy Policy (hereinafter referred to as the Policy) applies to all personal data that the operator of the AWX service (hereinafter referred to as the Operator) may obtain about the User while the User is using the service and in the course of the Operators performance of any agreements or contracts with the User.
This Privacy Policy governs the processing of personal data exclusively of Users who are citizens of the Russian Federation. If the User is a citizen of another country, the processing of such Users personal data is carried out in accordance with the terms published at: https://awx.pro/en/docs/policy.
SERVICE the website available at: https://awx.pro/ru, the AWX mobile application, and the Telegram bot available at: https://t.me/shop.
Use of the Service constitutes the Users full and unconditional acceptance of this Policy and the terms of personal data processing described herein. If the User does not agree with these terms, they must refrain from using the Service.
The Users personal data is processed on the basis of agreements and contracts between the User and the Operator.
1. PERSONAL DATA OF USERS PROCESSED BY THE OPERATOR
1.1 Basic Provisions:
1.1.1 The type of personal data that the Operator collects depends on how the User interacts with the Service. In some cases, the User may choose to provide personal data or abstain, but if the User abstains from providing such personal data, not the full functionality of the Service may not be available to the User. When the User uses the Service, the User may provide the following types of personal data:
- personal data that he voluntarily discloses and that is collected on an individual basis;
- personal data collected automatically when using the Service;
- personal data collected by the Operator from sources other than the Service.
1.1.2 The Service contains links to other third-party websites that may collect personal data about the User, including through the use of cookies or other technologies. If the User uses our links to visit other websites, services, this Policy will not apply to the User's use and activity on those other websites. The User should familiarize themselves with the privacy policies of these other websites, as the Operator has no control over them and is not responsible for any information provided or collected by these third parties.
1.1.3 The Operator does not verify the reliability of personal data provided by the User and has no possibility to assess the User's legal capacity. However, the Operator assumes that the User provides true and sufficient personal data and keeps these personal data up to date. Consequences of providing unreliable or insufficient personal data are defined in the Terms of Use of the Service.
1.2 Personal data provided by the User
1.2.1 In order to fulfill the Operator's obligations to provide the User with access to the Service in accordance with the Service Terms of Use, the Operator has the right to obtain the following personal data from the User, including (but not limited to):
- FULL NAME;
- Citizenship;
- Date, year of birth;
- Passport data;
- E-mail;
- User's location;
- Phone number;
- Telegram ID and Telegram username.
The types of personal data listed in this clause 1.2.1 of the Policy are collected only upon voluntary offer and exclusively for the purposes clearly defined in this Policy.
1.3 Personal Data collected automatically.
1.3.1 The User's Personal Data collected or transmitted to the Operator in the course of accessing, interacting with and using the Service may include, without limitation, the following personal data:
- Device information, which may include (but is not limited to) information about the computer or mobile device you use to access the Service, including hardware model, operating system and version, web browser used and other device identifiers. Server log data, which may include, but is not limited to, User login information, date and time of visits, User's IP address, device geolocation, and time spent on the Service;
- information collected through cookies and other tracking technologies. The Operator and the Operator's service providers use various technologies to collect information when the User interacts with the Service, including cookies and web beacons. Cookies are small data files that are stored on the User's device when the User uses the Service that allow the Operator to collect information about the User's device identifiers, IP address, web browsers used to access the Service, pages or features viewed, time spent on pages, and links clicked by the User. 2. PURPOSES OF PROCESSING USERS' PERSONAL DATA
2.1 The Operator collects and stores only those personal data that are necessary for providing the functionality of the Service or fulfillment of agreements and contracts with the User, except in cases or when the legislation provides for mandatory storage of personal data for a period defined by law.
2.2 The Operator processes the User's personal data for the following purposes:
2.2.1 Providing access to the Service in accordance with the Rules of Service use;
2.2.2. Execution of the User's requests, technical support of the User;
2.2.3 Proper fulfillment of tax obligations that may be imposed on the Operator;
2.2.4. Detection and prevention of violation of the User's Rules and this Privacy Policy;
2.2.5. Provision of personalized Service;
2.2.6. Communication with the User, including sending notifications, requests and information regarding the use of the Service, fulfillment of agreements and contracts;
2.2.7 Conducting research and development to improve the functionality of the Service; 2.2.8.
2.2.8. Targeting advertising materials and providing them to the User;
2.2.9. Carrying out statistical and other research on the basis of anonymized data.
3. OBTAINING PERSONAL DATA
3.1. Personal data of Users are obtained by the Operator:
3.1.1 By providing it to the User when registering in the Service, submitting applications, statements, filling out other registration forms in the Service or sending it by e-mail, reporting it to the Operator's support service phone number;
3.1.2 In other ways that do not contradict the current legislation and requirements of international legislation on personal data protection.
3.2 The Operator receives and starts processing the User's personal data from the moment of receiving the User's consent.
3.3 The consent to the processing of personal data is given by the User at the moment of the beginning of the use of the Service, including by marking in the box I agree with the Rules and Privacy Policy, by means of the User's conclusive actions.
3.4 The User may withdraw his/her consent to the processing of personal data at any time. To withdraw consent to the processing of personal data, it is necessary to submit a corresponding application to the Operator by available means of communication. In this case, the Operator shall cease their processing or ensure the cessation of such processing and, if the preservation of personal data is no longer required for the purposes of their processing, destroy personal data or ensure their destruction within a period not exceeding 30 (Thirty) days from the date of receipt of the said revocation. If the User revokes his/her consent to the processing of personal data, the Operator has the right to continue processing personal data without the User's consent only if there are grounds established by applicable law.
3.5 The User has the right to choose which personal data will be provided. However, in case of incomplete provision of the required data, the Operator does not guarantee the User's ability to use all the functions of the Service.
3.6 The User may at any time view, update or delete any personal data specified in the personal account. To do so, he/she may edit the data contained in the personal account online or send an e-mail to: support
4. CONDITIONS OF PROCESSING PERSONAL DATA OF USERS AND THEIR TRANSFER TO THIRD PARTIES
4.1 The Operator stores Users' personal data in accordance with the applicable legislation, this Policy and the Operator's internal regulations.
4.2 The User's personal data shall be kept confidential, except for cases when the User voluntarily provides his/her personal data for public access to an unlimited number of persons.
4.3 The Operator has the right to transfer the User's personal data to third parties in the following cases:
4.3.1. the User has expressed consent to such actions;
4.3.2. The transfer is necessary for the User's use of the Service or for the fulfillment of a certain agreement or contract with the User;
4.3.3. the Transfer is provided for by Russian or other applicable law within the procedure established by law.
4.3.4 To ensure the possibility of protecting the rights and legitimate interests of the Operator or third parties in cases when the User violates the Service Terms of Use, this Policy, or other documents containing the terms of use of the Service or its part, or there is a threat of such violation.
4.3.5 Transfer of statistical data, which are obtained as a result of processing the User's personal data by depersonalizing them, to a third party to conduct research, perform work or provide services on behalf of the Operator.
4.4 In cases permitted by law, the Operator may transfer the User's personal data to third parties and state authorities outside the User's country of residence. Personal data may be processed by an employee of the Operator or the Operator's contractor working outside the User's country of residence. Such employees may be involved, among other things, in providing services to the User, processing payment orders and providing technical support services. By submitting his/her personal data, the User agrees to such transfer, storage or processing. The Operator will take all necessary measures to ensure reliable processing of such personal data in accordance with this privacy policy. In case of necessity to transfer the User's personal data to a state that does not provide adequate measures of personal data protection, the Operator will notify the User and obtain a separate consent for such transfer.
5. MODIFICATION AND DELETION OF PERSONAL DATA AND MANDATORY DATA STORAGE
5.1 The User may request to stop the processing of his/her personal data in the Service by sending a corresponding message indicating the name of the account to the e-mail address specified in clause 9 of the Policy.
5.2 The rights provided by this Policy may be restricted in accordance with legal requirements. In particular, such restrictions may provide for the Operator's obligation to retain the data changed or deleted by the User for the period established by the legislation and to transfer such data in accordance with the legally established procedure to the state authority.
5.3 Personal data about the User is processed by the Operator throughout the entire period of the User's use of the Service and/or validity of agreements and contracts with the User, taking into account the requirements stipulated by the legislation of the Russian Federation.
6. PROCESSING OF PERSONAL DATA BY MEANS OF COOKIES AND COUNTERS
6.1 Cookies transmitted by the Operator to the User's equipment and the User's equipment to the Operator may be used by the Operator to personalize the provision of information to the User in the Service, for statistical and research purposes, as well as to improve the Service.
6.2 The structure of the cookie file, its content and technical parameters are determined by the Operator and may be changed without prior notice to the User.
6.3 The counters placed by the Operator in the Service may be used to analyze the User's cookies, to collect and process statistical information about the use of the Service, as well as to ensure the performance of the Service as a whole or its individual functions in particular. The technical parameters of the operation of the meters are determined by the Operator and may be changed without prior notice to the User.

7. MEASURES APPLIED TO PROTECT THE USER'S PERSONAL DATA
7.1 The Operator takes necessary and sufficient organizational and technical measures to protect the User's personal data from unlawful or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful actions with it by third parties.
8. CHANGE OF PRIVACY POLICY AND APPLICABLE LAW
8.1 The Operator has the right to make changes to this Privacy Policy. The new version of the Policy comes into effect from the moment of its posting, unless otherwise provided by the new version of the Policy.
