AWX Terms of Service  

In this document you will find our terms of service and general rules.

AWX ACCOUNT REGISTRATION  

All users must apply to create an AWX account before using the AWX Services. When you register an AWX account, you must accept these terms, the privacy policy and other rules of the AWX platform. AWX may, at its discretion, refuse to open an AWX account for you. You agree to provide complete and accurate information when opening an account and agree to promptly update any information you provide to ensure the integrity and accuracy of the information. Each user (including an individual, commercial or legal entity) may have only one primary account at any time. Your registration of an account on AWX will be deemed your consent to provide the necessary personal information for identity verification. Such information will be used to verify the identity of users, detect traces of money laundering, terrorist financing, fraud and other financial crimes through AWX, or for other legitimate purposes stated by AWX.

We will collect, use and share such information in accordance with our privacy policy. In addition to providing such information, you agree to allow us to maintain records of this information for the period during which your account is active, and for five (5) years after your account is closed in accordance with global industry data retention standards. You also authorize us to conduct necessary investigations directly or through a third party to verify your identity or protect you and/or us from financial crimes such as fraud. The information we need to verify your identity may include, but is not limited to, your name, email address, contact information, phone number, username, government-issued identification, date of birth and other information collected during account registration. By providing the required information, you confirm its validity and accuracy.

AWX SERVICES  

After completing registration and identity verification for your AWX account, you may use various AWX services for exchange with fiat currencies and vice versa, including using cash rubles in the territory of the Russian Federation, related data, research and other information.

AWX has the right to: provide, modify or terminate, at its discretion, any AWX services based on its development plan; and allow or prohibit certain users from using any AWX services in accordance with the relevant platform rules.

Digital Asset Exchange  

After completing registration and identity verification for your AWX account, you may carry out digital asset exchange transactions for fiat funds and vice versa in accordance with these terms and the rules of the AWX platform.

Fees: You agree to pay AWX a fee for exchange transactions. AWX may, at its discretion, update the fee amount at any time. Updated fees apply to transactions made after the effective date of the changes.

TERMINATION OF THE AGREEMENT  

1. Suspension of AWX Accounts

You agree that AWX has the right to immediately suspend your AWX account (and any accounts beneficially owned by related persons or affiliates), freeze or block Digital Assets or funds on all such accounts, and suspend your access to AWX for any reason, including if AWX suspects that any such accounts violate these terms, our privacy policy or any applicable laws and regulations. You agree that AWX shall not be liable to you for any permanent or temporary change to your AWX account, nor for the suspension or termination of your access to all or any part of the AWX Services. AWX also reserves the right to retain and use transaction data or other information related to such AWX accounts. The aforementioned account controls may also apply in the following cases:

• The AWX account is the subject of government proceedings, criminal investigation or other pending litigation;
• We detect unusual activity in the AWX account;
• We detect unauthorized access to the AWX account;
• We are required to do so by court order or regulatory/government authority directive.

NO FINANCIAL ADVISORY SERVICES  

AWX is not your broker, intermediary, agent or advisor and has no fiduciary relationship or obligation to you in connection with any transactions or other decisions or actions taken by you using the AWX Services. No communications or information provided to you by AWX are intended or should be considered or construed as investment advice, financial advice, trading advice or any other advice. Unless otherwise specified in these Terms, all transactions are executed automatically based on the parameters of your order instructions and in accordance with published transaction execution procedures, and you are solely responsible for determining whether any investment, investment strategy or related transaction is suitable for you. In accordance with your personal investment objectives, financial circumstances and risk tolerance, and you are solely responsible for any losses or liabilities associated therewith.

DISCLAIMER OF LIABILITY  

AWX provides digital asset exchange services for fiat funds and vice versa, AWX does not store your funds. AWX is not responsible for the loss of your personal data or credentials, which may affect unauthorized withdrawal of funds or trading. Please pay attention to the storage of personal data and credentials, use strong passwords and two-factor authentication.

AWX cannot and does not guarantee that files or data available for download from the Internet, or software, will not contain viruses or other destructive code. You are solely and fully responsible for your use of the software and the security of your computer, Internet and data.

AWX makes no warranties or representations regarding the software, including, without limitation, the following:

• the software will meet your requirements;
• the software will be uninterrupted, timely, secure or error-free;
• the results obtained from using the software will be accurate or reliable; or
• any known or unknown defects will be corrected.

AWX has the right, at its discretion, to change the list of services provided, introduce new services, temporarily suspend or completely cease the provision of individual services without prior notice to Users in cases where:

• it is necessary to comply with applicable legislation;
• technical problems or force majeure circumstances arise;
• it is required to ensure the security of Users' funds;
• the terms of work with counterparties or partners of the service change.

AWX is not responsible for:

• losses of the User arising from improper use of the service or violation by the User of these Rules;
• losses arising from actions or inactions of third parties, including counterparties, partners, payment systems, government bodies;
• lost profits and other indirect losses of the User;
• losses arising from force majeure circumstances.

DEPOSIT AND WITHDRAWAL OF FUNDS  

You may carry out exchange transactions in digital and fiat currencies supported by the AWX service. If client transactions appear suspicious, AWX has the right to request additional information about the transactions and suspend some or all operations from your account for an indefinite period of time.

SANCTIONS LIST  

Residents of the United States and other countries on the sanctions list are prohibited from opening an exchange account. By agreeing to the terms, you confirm that you are not a resident of any prohibited country.

Sanctions risks and counterparty risks. The User acknowledges and accepts that the service's activities may be affected by the imposition of sanctions against the service's counterparties by government authorities of various jurisdictions. In the event of such sanctions, the User's funds and/or digital assets held in counterparties' accounts or wallets may be frozen, seized or temporarily unavailable for withdrawal. AWX takes all possible measures to return client funds in the event of such situations, but cannot guarantee the timing or completeness of such return due to force majeure circumstances. The User assumes this risk when using the service.
